OPINION: PROF AMUPITAN'S REFUSAL TO OBEY COURT ORDER: A PANACEA FOR POLITICAL INSTABILITY IN NIGERIA, Says NNPP
The New Nigeria People's Party wishes to alert Nigerians to the persistent danger to the 2027 general elections being deliberately orchestrated by Prof. Joash AMUPITAN, the Chairman of the Independent National Electoral Commission.
The internal dispute within the NNPP had long been resolved by various court judgements in Abia, FCT High Court, Apo Division, as well as a Court of Appeal, Owerri Division judgement delivered in favor of the Agbo Major led leadership.
It is alarming that INEC which is supposedly expected to be an unbiased commission had disturbingly taken sides, constantly refusing to obey valid court judgements delivered by justices of competent courts of jurisdiction, particularly the judgement delivered by Justice Kawu in Suit No. CV/4800/25/2005 wherein all issues and prayers before the court were resolved in favor of the Agbo Major led leadership.
In a recent meeting convened by the INEC Chairman on May 15th, 2026, in respect to the disobedience of the judgements, Prof. AMUPITAN had boasted openly at the meeting that he was not duty bound to obey court judgements obtained by the Agbo Major led leadership against parties who are now members of known opposition political parties.
This lawless position is not only worrisome but a travesty against all norms of impartiality an umpire of his standing has sworn under the constitution of the Federal Republic of Nigeria to uphold.
The NNPP view Prof. Amupitan's insistence on disobeying court judgements, including an order of mandamus given by Justice Kawu to compel the commission to recognize the Agbo Major led leadership as anarchistic, lawless and an invitation to political instability.
The recent recourse to initiate a contempt proceeding against the Chairman of the commission remains the ONLY lawful step to ensuring that the chief electoral umpire does not exercise powers above the courts and lawful judgements obtained from courts of competent jurisdiction.
That Prof. Amupitan's insistence on disobeying court judgements is now visible; albeit against good reasoning is no doubt a deliberate precipitation designed to derail the electoral timetable, cause dissaffection, political instability and loss of almost a trillion Naira budgetary allocation earmarked for the 2027 polls.
No matter the delay and denial, Prof. Amupitan's actions will not escape justice. NNPP will not abandon this path of justice until Prof. Amupitan obeys the lawful judgements of the courts.
The attention of the Attorney General of the Federation, as the chief law officer is hereby drawn to this avoidable circumstances, and it's our hope that he engage the Chief Judge of the Federation as the head of judiciary in Nigeria to defend and protect his jurisdiction jealously
Prof. Amupitan is not above the law and he is duty bound to obey judgements of the Court.
