18th February, 2022 at the Federal High Court Abeokuta on the sitting of the Bamgbose Samson's suspension as the State Chairman of Ogun State PDP.
Right from the entrance to the premises of the Court security was highly beefed up as only the principal parties and necessary stakeholders were allowed in. DSS, Police and Civil Defense were armed to the teeth.
The kennel was centered on the suspension of Bamgbose Samson by his State Working Committee. Sequel to his suspension which Bamgbose considered to be a gross violation of his right and abuse of the process as laid down by the Constitution's of PDP. Section... of the PDP Constitution states spelt out and laid down the procedure of suspending members of the National Executive Committee and in the case of Bamgbose the procedure was grossly violated. It was in such that Bamgbose Samson approached the Federal High Court for the review of his suspension which was done in condone and without recourse to the laid down provisions of sections of the party's constitution.
The suit number is; FHC/AB/CS/112/2020 an the parties are: SAMSON BAMGBOSE &ORS V. REMI BAKARE &ORS. The matter is presided over by Justice J.O. Andulmaliq of Court 2, Federal High Court, Abeokuta.
Today proceeding is basically delivery of judgment on the issue of suspension of Bamgbose Samson as the State chairman of PDP Ogun state either for his suspension to be quashed or dismissed the application.
The defendants sought for the dismissal of the application based on lack of jurisdiction.
The defendants Counsel duel on the justiciability of the suit as it bothers on the extra affairs of political party and internal runnings of the party. So, the Court has no or lacks jurisdiction to entertain the case.
The court rules against the plaintiffs, Bamgbose Samson & ORS and admitted lack of jurisdiction and locus standi to adjudicate over the matter and the suit was dismissed.
