GOVERNOR ABIODUN, OGHA SHOULD CALL THE FRSC TO ORDER ON THEIR ILLEGAL ACTIVITIES ON OUR TOWNSHIP ROADS, by Ajiroba Dapo Oke 11
We read on a national newspaper recently about a court judgment that Road Safety Corps are not supposed to operate on township roads. This had been in addition to another court ruling that they are not empowered in law to fine motorists on the highway thereby usurping the power of the courts.
Federal Road Safety Corps is a Government Agency with statutory responsibility for road safety administration in Nigeria. In particular, the Commission is charged with responsibilities to Prevent or minimize accidents on the highway. Clearing obstructions on any part of the highways. Educating drivers, motorists and other members of the public generally on the proper use of the highways.
They are therefore created to ensure safety on Federal highways . But the FRSC officials in the State capital of Ogun state and elsewhere in the State will always be found around Oke Ilewo , brewery, Akin Olugbade and opposite the CBN and other township roads harassing motorists and extorting money from commercial taxi and bus drivers. They always target when Civil servants will be returning from work. I remember Governor once sent them away from oke ilewo area opposite Iwe irohin.
The FRSC officials in the State had completely abandoned their responsibility of ensuring road safety maintenance and accident emergency ambulance services on our major highway, they are now pre-occupied with checking of seat belt and expired tyres defaulters within township roads with women drivers being their main targets .
Come and see them on the highway also where they focus more on private vehicle owners. All these rickety commercial taxis ,buses and trucks with overloads, and emission defaulters are given free passages since they are their customers dadaa ni
Today, we are complaining about SARS what about this yet another agency of the Government also becoming lawless and a thorn in the flesh of motorists in the metropolis
The fact is that Ogun state has TRACE, VIO and parks and garages who are created to control traffic regulations and compliance within the metropolis why has the FRSC abandoned their primary responsibilities to be chasing shadows on our township roads .
Let the Governor and the OGHA please rescue us from these toll collectors
FRSC HAS POWER TO OPERATE ON ALL THE ROADS IN THE FEDERATION
ReplyDeleteI want to educate the public about the responsibility of Federal Road Safety Corps, they are not mandated on only Highway alone, the law that established the Corps mandate them to perform on all the roads in the Country. They have capacity to check your vehicles both commercial, private, even government vehicles are not excepted from arrest. What I know better is that the public are quilty of the FRSC offences that is why they are complaining everytime. Let's put everything in place so that our life will not be at risk everytime. I'm imploying all our citizens to be law abiding. You can go and read NRTR 2012 law very well and see where the law has empower them to work on every part of the country roads. Both Township or Highway. They didn't focus on SEATBELT, EXPIRED TYRE alone, they still have Overspeeding, using of phone while driving, driving without Passanger Manifest, Overloading, Dangerous Driving that most drivers like to perform on the roads. They always go out for Public Education everytime, they perform what we called Morning Cry where they preach to the Drivers and the Passengers every blessed morning. There is another things our drivers like doing that kills passengers more than anything is the way our drivers they drink alcoholic base drinks in the early morning before they embark on their journey which is bad and kills faster more than anything. They go for prompt rescue services, They have effective Motor vehicle Administration etc. Nobody or No FRSC staff they extort any body on the roads. They are well trained and disciplined personnels. They are Exemplary personnels of the Corps. I believe the Gov. Dapo Abiodun know better. I'm not part of the Corps but I move closer to them and I know what they can do. Have read their Establishment Act 2007 very well and I see what they can offer to the citizens of this Country...
All the citizens should asked for what they Called HIGHWAY CODES and see their duties, inside the Highway code there is a page where citizens we see where the FRSC can perform their responsibilities.
The Citizens that is complaining has guilty of many offences, some doesn't have drivers licence if you asked them very well, that is why they are complaining or accusing the FRSC and saying they don't have rights to operate on Township roads. There is no law that said FRSC should not perform their responsibility on the Township roads.
Read Punch July 17,2020 and see the Court Judgment between FRSC & MR. ABU
Justice Anwuli Chikere of the Federal High Court in Abuja has ruled that the Federal Road Safety Corps (FRSC) has the powers to enforce traffic rules on all public roads.
The Wednesday judgment delivered in favour of the corps resulted from a suit filed by one Pius Abu.
Mr Abu had accused the FRSC of wrongfully impounding his car for using a telephone and subsequently impounding his car in Abuja in May 2019.
According to PUNCH newspaper, the plaintiff claimed he was apprehended by FRSC operatives at ECWA Junction, Wuse II, Abuja and they impounded his Peugeot 306 car on May 6, 2019.
He further stated that the agency lacked the power to enforce traffic law on the road not stipulated in the FRSC (Establishment) Act.
Meanwhile, Justice Chikere ruled that “It is wrong to limit the enforcement of the traffic rules to the roads listed in the Federal Road Safety Corps (Establishment) Act when the Act gives the 2nd defendant (FRSC) to enforce the traffic rules on all public roads in other legislations.”
She also declared that FRSC is empowered to arrest and prosecute anybody found to violate traffic rules on any public road.
Citing section 35 of the FRSC Act, the judge held that the 2nd defendant can impound any vehicle found to have committed any offence in the Act.
Confirming the court’s ruling, the spokesperson of the FRSC, Bisi Kazeem said Mr Abu did sue the agency but the court ruled against him.
Well, I want to stop here..

Hi
ReplyDeleteI want to educate the public about the work of FRSC personnel. And I want to asked the Public this question, if there is Accidents along the Township roads or state government roads. Is it good for the FRSC personnel to go and perform Rescue Services. If the answer is YES, that means the Personnel has right to discharge their responsibilities in all Public roads in the state. We should stop in diverting from the truth. If we are guilty of the Corps Mandate/responsibilities/Offences, we should follows what they want in other to stay healthy and long life. What the Citizens of OGUN state needs is Public Enlightment or Orientation about what we supposed follows. Stay away from accusing bad fingers to the FRSC Personnel and perform the right things. If today DAPO ABIODUN direct the FRSC not to Operate along the Township roads again. Then stop calling them for prompt Rescue Services for your injured citizens also. since the day FRSC apprehend me and educate and enlighten me on the usefulness or given me more education about Dangerous driving, Overloading, Seatbelt violation, Expired Tyres or wornout tyres, usefulness of Drivers license, have been in good thought for them and starts elongate them for work done for the Nigeria Citizens.
